FAA Temporary Flight Restriction (TFR) exemption for CL

Hi all,

My father is slated to do a model demonstration at a local high school tomorrow, when all of a sudden a NOTAM popped into my mailbox informing all of a TFR in the area thanks to our beloved Commander In Chief. Fortunately for us, after a brief panic, we realized that the times that the TFR is in effect will not interfere with the demo. However, that does raise the question.

The FAR is very clear--model aircraft, regardless of type of control, is prohibited.

However, the following was posted on stunthanger:


"...Control line flying is not included in the TFR only RC. This is a Homeland security and Secret Service issue. I’ll have Rich add a line stating that Control line is not restricted by the TFR..."


Seems like the FAA didnt get that memo because the latest NOTAM still reads "No model airplanes". The questions I have is, where in writing, preferably something in the form of an FAR or similar document, stating that control line is excluded? This is something worth exploring, in the inevitable event that our Prez decides to roll into town on the day of someone's contest.

I would be interested in both the added language you cite and whether or not the AMA/government liason team agrees with the position that you presented above. I pursued this back in May 2011 in a letter to Rich Hanson. Unless something has changed, his view was that DHS, the SS and SOSC did not recognize a distinction or exemption for control line aircraft, nor was Rich comfortable pushing this issue as the AMA position while concurrently working with the FAA on the definition of a model aircraft vs. a UAV. Perhap we need to have the parties state their understandings of the situation again.

I agree that the TFR restriction that applies to both Whittier Narrows and Sepulveda Basin simultaneously seems onorous considering these are, in fact, tethered models with a legal maximum altitude of approximately 79 feet, depending on the pilots height....

Even stranger, the parks and rec folks may shut down the tether car guys, because they also consider these models(?)

This whole TFR business is laughable since it applies only to law-abiding citizens. Does anyone really think a Jihadist (or raghead sympathizer) cares one whit about a TFR when plotting an attack?

I think the idea is to make the "Jihadist" stand out a bit more. Sort of like telling everyone in a crowd to sit down and stay put while security does a walk-through looking for someone. The guy who gets up and runs out of the room is a good one to check up on.

Mikey: C'mon dude....it takes any aircraft...especially model aircraft, along time to travel 30nm, giving SS time to neutralize a threat. Pat's pretty on with his assessment. Any accidental A/S violator would immediatly bug out and go home...as well as the aforementioned "raghead" who is smart. If he keeps going...shoot. Not quite that simple, but thats the short of it.

When our fearless leader visited the peoples republic of Los Angeles late in Sept, the AMA sent out an email notice that all model aircraft 30 nm from LAX would be grounded, some folks didn't get the message and went to Whittier Narrows and flew C/L, and saw R/C flying as well. I think the Parks and Rec doesn't have a hotline to the FAA or Fed Gov, and wasn't aware of the grounding. Now aren't you glad for gov inefficiency?
Buy the way, is a C/L model aircraft truely defined as such, or is it more like a (powered) kite? How about the tether car track?

When Toronto was "lucky enough" to host the G20 last year kite flying was included in the list of banned activities.
